  • (potential) clients of WB Legal Services B.V.;
  • visitors to the website muschlegal.com;
  • recipients of our newsletter or other communications;
  • applicants;
  • suppliers, advisors, and other business relations.

4. Which personal data does WB Legal Services B.V. process?

WB Legal Services B.V. processes the following (categories of) personal data:

  • name, address, and place of residence details (NAW data);
  • contact details, such as email address and phone number;
  • business data, such as company name, Chamber of Commerce number, and VAT number;
  • date of birth and gender;
  • bank details (IBAN);
  • copy of identification document (insofar as legally required under the Wwft);
  • job title and any other title;
  • information you provide via correspondence, telephone contact, or contact forms;
  • technical data, such as IP address, browser type, and browsing behavior on our website.

This data is obtained because you provide it yourself, it is generated in the context of our services, it is communicated to us by third parties (such as opposing parties), or it has become known through public sources.

5. For what purposes does WB Legal Services B.V. process your personal data?

WB Legal Services B.V. processes personal data exclusively for the following purposes:

  • providing legal services, including the performance of contracts and conducting (legal) proceedings;
  • collecting fees and maintaining financial administration;
  • complying with legal and statutory obligations, including obligations under the Money Laundering and Terrorist Financing (Prevention) Act (Wwft) and the Lawyers Act;
  • maintaining contact with clients and other relations;
  • marketing and communication purposes, such as sending our newsletter (only with your consent or if you are an existing client);
  • recruitment and selection of personnel;
  • improving our services and website.

6. On what legal grounds does WB Legal Services B.V. process your personal data?

WB Legal Services B.V. processes personal data on the basis of one or more of the following legal bases as referred to in Article 6 GDPR:

  • Performance of a contract – for handling your case and invoicing our services;
  • Legal obligation – for complying with tax obligations and obligations under the Wwft and the Lawyers Act;
  • Legitimate interest – for improving our services and maintaining contact;
  • Consent – for sending the newsletter and other marketing communications. You have the right to withdraw your consent at any time.

7. Retention Periods

WB Legal Services B.V. does not retain personal data longer than necessary for the purposes for which it was obtained, or as far as laws and regulations require. The following retention periods serve as a guideline:

  • File data (case data): five years after the closing of the file, unless a longer statutory retention period applies;
  • Financial administration (invoice data): seven years, in accordance with tax retention requirements;
  • Application data: a maximum of four weeks after the completion of the application procedure, unless you give permission for a longer retention period.

8. Provision to third parties

WB Legal Services B.V. only provides your personal data to third parties insofar as this is necessary for the performance of our services or is legally required. This may include:

  • other lawyers or substitute counsel in case of absence;
  • experts, bailiffs, or other third parties engaged in the context of a case;
  • IT suppliers and other service providers who process personal data on behalf of WB Legal Services B.V.;
  • judicial authorities, supervisory bodies, or government agencies, insofar as a legal obligation exists;
  • opposing parties or their representatives in the context of legal proceedings or negotiations.

With parties that process personal data on behalf of WB Legal Services B.V. (processors), we conclude a data processing agreement that meets the requirements of the GDPR. Third parties acting as independent data controllers – such as accountants and notaries – are themselves responsible for compliance with the GDPR.

If personal data is transferred outside the European Economic Area (EEA), this only occurs to countries for which an adequacy decision applies, based on appropriate safeguards (such as EU standard contractual clauses), or to parties certified under the EU-U.S. Data Privacy Framework.

9. Security

WB Legal Services B.V. takes appropriate technical and organizational measures to secure and protect your personal data against unauthorized access, loss, or misuse. Specific agreements regarding security measures are made in data processing agreements with IT suppliers and other service providers.

The website muschlegal.com uses cookies for statistical purposes. We use Google Analytics to analyze user behavior and general trends. The data collected in this way is, in principle, anonymous. By using our website, you consent to the processing of this information by Google in the manner and for the purposes described in our cookie policy.

You can refuse the use of cookies at any time via your browser settings, although this may limit the website's functionality.

10.2 Social media

Our website includes buttons and/or links to social media platforms such as LinkedIn. WB Legal Services B.V. does not supervise and is not responsible for the processing of your personal data by and through such third parties. We advise you to consult the privacy policy of the respective platforms before using them.

11. Your privacy rights

Under the GDPR, you have the following rights:

  • right to access your personal data;
  • right to rectification of inaccurate or incomplete data;
  • right to erasure ('right to be forgotten');
  • right to restriction of processing;
  • right to data portability;
  • right to object to processing;
  • right to withdraw previously given consent.

Requests to exercise your rights can be sent to info@muschlegal.nl, stating 'Privacy request'. To verify your identity, we may ask you to provide a copy of a valid identification document with your BSN (citizen service number) redacted and a passport photo. We aim to respond to your request within one month.

There may be circumstances in which WB Legal Services B.V. cannot or can only partially comply with your request, for example due to the legal duty of confidentiality of lawyers or applicable statutory retention periods.

If you believe that WB Legal Services B.V. is processing your personal data in violation of privacy legislation, you have the right to file a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

12. Amendments

WB Legal Services B.V. reserves the right to amend this privacy policy. Changes will be published on muschlegal.nl. We advise you to consult this page regularly.
